Real estate investment in Iraq: what you need to know about residential and industrial investment licences

An investment project may begin with land in a suitable location, a plan for a residential complex, or a market need for a new factory. The investment licence then gives the project a legal framework. But the question that deserves attention is: is the licence alone enough to start work and deal with the land?

The licence is an important step, but it does not sum up the whole file. There is a difference between the project licence, the legal right to the land, and the approvals needed for construction or operation. An investor may obtain a licence while matters relating to the land contract, its handover or the project designs still need to be completed.

That is why studying an investment starts by gathering these parts and reading them together. Which project did the commission license? Who is the investor named in the licence? What are the area and boundaries of the land? On what basis will the investor occupy it? And when do the obligations relating to completion begin?

A licence is not a title deed

One of the mistakes that can confuse an investor is treating the investment licence as if it were a title deed to the land. The licence does not, by itself, transfer ownership.
